Terms and conditions
These terms govern your use of Testlar, operated by Solo Founder. Please read them before creating an account or buying credits.
1. Who you are contracting with
Testlar is operated by Solo Founder (“Testlar”, “we”, “us”). By creating an account or using Testlar you enter into an agreement with Solo Founder. You may contact us at support@testlar.com.
2. Acceptance of these terms
By creating an account, purchasing credits, or continuing to use Testlar, you agree to these terms. If you do not agree, stop using the service. You must be of legal age in your country, or have permission from your school or guardian, and if you act for an organisation you confirm you are authorised to bind it.
3. Accounts
You must give accurate information and keep it current. You are responsible for keeping your password confidential and for all activity under your account. Tell us immediately if you suspect unauthorised access.
4. Acceptable use
You must not use Testlar unlawfully; commit fraud or send spam; infringe anyone's intellectual property; upload malware; probe, scan or interfere with the security or integrity of the service; scrape it; resell or redistribute access; reverse engineer it; or work around technical limits such as credit balances or attempt limits.
5. Your content
You keep ownership of the tests, questions and answers you upload. You grant us a limited licence to host, store and process that content solely to operate the service for you and the people you share tests with. You confirm you have the rights to the content you upload.
6. Our intellectual property
We retain all rights in the Testlar software, design, documentation and branding. You receive a limited, non-exclusive, non-transferable right to use the service under these terms. Nothing here transfers ownership of our intellectual property to you.
7. Credits and payment terms
Testlar runs on prepaid credits. Credits are sold in bundles at the rate of 10 credits for US$1 with a minimum purchase of 50 credits, and are spent on usage such as creating tests and taking library tests. Prices are shown before you pay. Credits have no cash value, are non-transferable, and are not a stored-money product. Free monthly allowances are provided at our discretion and may change.
8. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are covered by Paddle's Buyer Terms at paddle.com/legal/checkout-buyer-terms, alongside our own refund policy.
9. Service availability
We work to keep Testlar available and reliable, but we do not guarantee uninterrupted or error-free operation. Maintenance, upgrades and events outside our reasonable control may interrupt access.
10. Warranties and liability
To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability is limited to the amounts you paid us in the 12 months before the claim. We are not liable for indirect or consequential loss, including lost profits, data or goodwill. Nothing excludes liability for fraud, death or personal injury where the law does not allow it.
11. Indemnity
You will indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these terms.
12. Suspension and termination
We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using Testlar at any time and can deactivate or delete your account from your dashboard. On termination your access ends and unused credits are forfeited unless a refund is due under our refund policy or applicable law.
13. Changes
We may update these terms as the service evolves. Material changes will be reflected on this page, and continued use after an update means you accept the revised terms.
14. Governing law
These terms are governed by the laws applicable at our place of business, and disputes will be handled by the competent courts there, unless local consumer law gives you a different right.
